This Privacy Policy applies to the website: http://themeist.com/  (the “Service”) owned and operated by Webtions OÜ, registry code 14437054, located at Sepapaja 6, Tallinn 15551, Estonia (hereinafter “Webtions“, “Themeist“, “we”, “us” and “our”).

This Privacy Policy describes how Webtions collects, uses, shares and secures the personal information you provide, as well as the information we collect automatically. It also describes your choices regarding use, access, correction, and deletion of your personal information. We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

The privacy of customer’s personal data is important to Webtions. Therefore, we consider it necessary to inform our customers about data being collected, the purposes of such collection, requirements for retention and rights related to the processing of the personal data.

If the Customer does not agree with any or all terms of this policy or any possible changes to it, then he/she should immediately close the website and cease using the services provided by Webtions.

We collect the following personal information from you:

You can register on our website in order to access additional functions offered here. The input data will only be used for the purpose of using the respective site or service for which you have registered.

Some of the data we collect are:

  • Contact Information, such as name, email address, mailing address, or phone number;
  • VAT number
  • Unique Identifiers, such as username, account number or password;
  • IP address;
  • Information about your business, such as company name, address.

The mandatory information requested during registration must be provided in full.  If you do not provide this information, we will not be able to provide the Services to you.

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract with us, for example, to payment gateway/bank entrusted to process your payments.

Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent.

If the Customer chooses to pay for the Service by credit card or by PayPal, his/her payment details are not stored by Themeist and therefore cannot be accessed by Themeist.

( 2.1.2 ) Contact Form

Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

( 2.1.3 ) Comment Form

If you use the comment function on this site, the time at which you created the comment and your email address will be stored along with your comment, as well as your username, unless you are posting anonymously.

Storage of the IP address

Our comment function stores the IP addresses of those users who post comments. We need this information to be able to pursue an action for illegal or slanderous content.

How long comments are stored

The comments and the associated data (e.g. IP address) are stored and remain on our website until the content commented upon has been completely deleted or the comments are required to be removed for legal reasons (slander, etc.).

Google Analytics may also receive information about you from apps you have downloaded, that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Personal Data collected by Themeist is processed for the purposes established in the law or as described herein, including but limited for the following purposes:

  • To provide and maintain our Service
  • To notify you about changes to our Service
  • To allow you to participate in interactive features of our Service when you choose to do so
  • To provide customer support
  • To gather analysis or valuable information so that we can improve our Service
  • To monitor the usage of our Service
  • To detect, prevent and address technical issues
  • To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information

Themeist shall not use Customer’s Personal Data for any other purpose incompatible with the purposes outlined above or required, permitted or authorized by law.

( 4 )  Retention of Data

We may retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes and enforce our agreements. In certain circumstances, we may be required by law to retain your personal information or may need to retain your personal information in order to continue providing a service.

Even if you delete your account, keep in mind that the deletion by our third party providers may not be immediate and that the deleted information may persist in backup copies for a reasonable period of time.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

( 8.1.2 ) Google ReCaptcha

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”).

reCAPTCHA is used to check whether the data entered on our website (such as on a contact form) has been entered by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, how long the visitor has been on the website, or mouse movements made by the user). The data collected during the analysis will be forwarded to Google.

The reCAPTCHA analyses take place completely in the background. Website visitors are not advised that such an analysis is taking place.

( 8.1.3 ) Fathom

We use an in-house analytics software called Fathom that tracks and reports website traffic. This data is hosted on https://harish.usesfathom.com/.

( 8.2 ) Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Our website accepts payments via PayPal. The provider of this service is PayPal (Europe) S.à.r.l & Cie, S.C.A. (22-24 Boulevard Royal, L-2449 Luxembourg.

If you select payment via PayPal, the payment data you provide will be supplied to PayPal. You have the option to revoke your consent at any time with future effect. It does not affect the processing of data previously collected.

( 8.3 ) Email Marketing

We may use third-party Service Providers to send marketing emails.

( 8.3.1 ) MailChimp

This website uses the services of MailChimp to send newsletters. This service is provided by Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service which organizes and analyzes the distribution of newsletters. If you provide data (e.g. your email address) to subscribe to our newsletter, it will be stored on MailChimp servers in the USA.

MailChimp is certified under the EU-US Privacy Shield. The Privacy Shield is an agreement between the European Union (EU) and the US to ensure compliance with European privacy standards in the United States.

We use MailChimp to analyze our newsletter campaigns. When you open an email sent by MailChimp, a file included in the email (called a web beacon) connects to MailChimp’s servers in the United States. This allows us to determine if a newsletter message has been opened and which links you click on. In addition, technical information is collected (e.g. time of retrieval, IP address, browser type, and operating system). This information cannot be assigned to a specific recipient. It is used exclusively for the statistical analysis of our newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to your interests.

If you do not want your usage of the newsletter to be analyzed by MailChimp, you will have to unsubscribe from the newsletter. For this purpose, we provide a link in every newsletter we send. You can also unsubscribe from the newsletter directly on the website.

You may revoke your consent at any time by unsubscribing to the newsletter. The data processed before we receive your request may still be legally processed.

The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription when said data will be deleted from our servers and those of MailChimp. Data we have stored for other purposes (e.g. email addresses for the members area) remains unaffected.

We have entered into a data processing agreement with MailChimp, in which we require MailChimp to protect the data of our customers and not to disclose said data to third parties. ( 8.5.1 ) Postmark

In order to ensure that e-mails relating to the ordering process and customer care arrive reliably at the recipient, we use Postmark, a service of Wildbit, LLC, 225 Chestnut St., Philadelphia, PA, 19106, USA. We have entered into a data processing agreement with Postmark, in which we require Postmark to protect the data of our customers and not to disclose said data to third parties.

( 9 ) Links to other websites

This Policy does not apply to any website, product or service of any third-party company even if the website links to (or is linked from) our Website.

( 10 ) Policy Regarding Children

The Services are not directed to children under the age of 16. We do not knowingly collect Personal Information from children under 16. If you are under 16, please do not use the Services and do not provide any personal information to us. If you become aware that a child under 16 has provided us with personal information without your consent, please contact us at support@themeist.com.

( 11 ) Browser Do Not Track

The Services honor and enforce Do Not Track preferences. Do Not Track (DNT) is a privacy preference you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page.
