Binding Agreement

The following terms and conditions are the rules by which you agree to be bound when using our free product or successfully purchase a Product from Themeist (Webtions OÜ)

Definitions

For the purposes of these terms and conditions, the definitions below apply whenever a term is capitalized or in uppercase and underlined. “Date of Purchase” means the date on which a commercial transaction with Themeist occurs. “End Product(s)” means a single instance of a Themeist theme/plugin having been installed for a personal or commercial project. “Intellectual Property Rights” means any and all proprietary rights, titles, and interests, including, but not limited to, trademarks, patents, and copyrights, as existing and recognized anywhere in the World on the Date of Purchase.

“Themeist” or “Webtions” means Webtions OÜ.

“Product(s)” means any free or paid for item, subscription, or service offered by Themeist.

“Product Update(s)” means subsequent updates to a Product released by Themeist for the purposes of, but not limited to, fixing bugs or adding features.

“Supported Browser(s)” means, subject to an express statement to the contrary,

(i) the most recent stable release version of Chrome, Firefox, or Safari; and

(ii) Internet Explorer 11 and above.

“Unsupported Browser(s)” means any browser not listed as a Supported browser.

Ownership

All plugins are the property of Themeist (Webtions OÜ). Claiming any type of intellectual or exclusive ownership rights of our products is strictly prohibited.

Our plugins & Themes are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur due to the use or inability to use our plugins.

Website & Plugin Content

All content found on this site and throughout the theme or plugin including images, documentation, support queries and any other information is the property of Themeist (Webtions OÜ) and may not be redistributed without permission or consent.

Payment

Customers have the option of choosing to pay via PayPal, major credit card or bank transfer from a European bank account. All payments are processed by Mollie.com. If you prefer to pay via direct bank transfer instead, please just write us and we’ll provide you with further details. The name on your credit card statement will appear as “Mollie * Webtions OÜ” or “PayPal *Webtions OU“.

All our prices include VAT if needed. Therefore during checkout, you will be asked to provide information about your home country for the correct price calculations. After the final price and VAT amount is calculated in the checkout process you can click the Buy button to finalize your payment.

For your security, we do not store your credit card or payment information on our site.

Each theme purchase grants you 1-year access to ongoing theme updates and support. After 1 year, to continue providing you with top-notch support and updates that ensure your theme works with the latest version of WordPress/Ghost, you will need to renew your license manually.

Only after your successful payment, you will receive an email from us including your individual download link and a PDF invoice for your records. If you don’t receive this email, please check your email spam folder. Otherwise please contact us directly at support@themeist.com for support.

It is important that you save the email including your download link, so you can always download the current theme version as long as your download link is valid.

Refund Policy

Theme purchases are eligible for a refund within seven (7) days from the Date of Purchase. After 7 days, no refunds will be given. Before a refund will be granted, you must allow us to try and help solve any problem you have by opening a support ticket.

Refunds will not be given for license renewals, so please contact us with any pre-purchase questions.

Refunds will not be granted if you simply decide not to use the purchased products. We stand behind our products and will assist you in solving any problem you have, but we also expect you to adequately understand what you are purchasing and why.

Price Changes

We reserve the right, at any time, to modify or discontinue, temporarily or permanently, a license with or without notice. Prices of all products are subject to change. Notice of price changes will be made on the site.

License

All digital goods provided by Themeist are released under the GNU Public License version 2.0 (GPL-2.0).

Product Support

Support for purchased themes is given up to one year after the purchase date. If you wish to get support after one year, you must purchase another license for the theme wish to get support for.

Support will not be given to questions relating to general PHP, Ghost or WordPress functionality or those that feature aggressive tones. Please note that WordPress has a big history of conflicts between plugins.

In order to get support, you must provide the email used to purchase our license.

A valid license grants you access to priority support over email, which covers help with setting up your product and directions on how to use the products. Our support service does not cover help with theme/plugin customization beyond the advertised features.

Theme Updates

Updates are included for free for up to one year after the purchase date. Updates can be downloaded from your account page.

Limitation of Liability

In no event will Themeist, or its suppliers or licensors be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials offered on this site. Even if Themeist or an authorized representative has been advised of the possibility of such damages. If your use of downloads from this site results in the need for servicing, repair, or correction of equipment or data, you assume any costs thereof.

Warranty

Our products are provided “as is” without warranty of any kind, either expressed or implied. We do not guarantee that our themes or plugins will work in all browsers, nor do we guarantee that our themes or plugins will be functional with all versions of WordPress or Ghost. We do not guarantee compatibility with any additional third party plugins, scripts, or applications.

Your Account

You are responsible for maintaining the security of your account and purchase, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with your account. You must immediately notify Themeist of any unauthorized uses of your account or any other breaches of security. Themeist will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Termination

Themeist may terminate your access to all or any part of the website at any time, with or without cause, with or without notice. If you wish to terminate this agreement or your Themeist account (if you have one), you may simply discontinue using the website. All provisions of this agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Note: If we find you’ve broken the agreement, we can suspend or terminate your account. No funny business.

Governing Law and Jurisdiction

These terms and conditions shall be governed and interpreted in accordance with the laws of Estonia. You consent to the jurisdiction of Estonia in respect of any claim you may have against Themeist.

Changes

Themeist reserves the right, at its sole discretion, to modify or replace any part of this agreement. It is your responsibility to check this agreement periodically for changes. Your continued use of or access to the website following the posting of any changes to this agreement constitutes acceptance of those changes.
